S.P.S.Rathore v C.B.I & Anr

 

The present Special Leave Petition was filed against the judgment and order of the High Court of Punjab & Haryana  confirming the judgment of the Sessions Court whereby the sentence of six months rigorous imprisonment and a fine of Rs.1,000/- imposed by the Trial court was enhanced to one year and six months. The petitioner was convicted and sentenced for an offence punishable under Section 354 of Indian Penal Code by the trial court.

 

Earlier C.B.I. opposed the bail application as three FIRs were pending against the petitioner. On the final date of hearing of the bail application, the Hon’ble Supreme Court was informed that  C.B.I. had filed two closure reports on 10th November, 2010. Insofar as the third FIR was concerned, by an order dated 25th January, 2010 the High Court of Punjab and Haryana had permitted the CBI to continue with the investigation but the final report shall not be  presented. Moreover, the petitioner had served more than six months out of the enhanced sentence of one year and six months.

The application for bail was allowed and the petitioner was ordered to be released  on bail subject to the condition that he shall not leave the country without specific permission of the Chief Judicial Magistrate, Chandigarh.
