SC waives off mandatory six months period in divorce by mutual consent

Petitioner and the second respondent had filed petition for a decree of divorce by mutual consent under Section 13B of the Hindu Marriage Act, 1955. In view of the long separation of seven years and the several rounds of litigation between the parties, the Supreme Court of India invoked its jurisdiction under Article 142 of the Constitution of India and waived off the six months’ period provided under Section 13B of the Hindu Marriage Act. The marriage between the petitioner and the second respondent was dissolved by way of divorce by mutual consent.
