Kanimozhi’s bail plea rejected by Supreme Court

The Special Leave Petitions filed by Sharad Kumar(Petitioner no.1) and Kanimozhi(Petitioner no.2) directed against the order passed by the Delhi High Court rejecting their bail petitions were  dismissed by the Supreme Court.

In the Supreme Court’s view the reasons assigned by the learned Special Judge and the learned Single Judge of the High Court for refusing to entertain the petitioners’ prayer for bail did not suffer from any legal infirmity. Liberty was granted to file fresh applications under Section 439 of the Code of Criminal Procedure, 1973 before the Special Court after framing of the charges. It was also observed by the Court that Kanimozhi shall be entitled to again invoke the provisions of Section 437 of the Code of Criminal Procedure, 1973.
